1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms") govern the purchase of license keys for the Epic Ham Software Suite ("Software") from Epic Ham Radio Software LLC ("Seller"). By completing a purchase, you ("Buyer") agree to these Terms and the Software's End User License Agreement.
2. LICENSE GRANT
Upon successful payment and license activation:
- You receive a non-exclusive, non-transferable license to use the Software as defined in the EULA
- The license is tied to a specific computer system via machine identification
- One license permits installation on one computer system
- Additional license keys available on request
- License keys are delivered electronically to the email address provided during purchase
3. PRICING AND PAYMENT
License Fees: All prices are listed in United States Dollars (USD) and are subject to change without notice. Prices displayed at the time of purchase are binding for that transaction.
Payment Methods: We accept payment via major credit cards, debit cards, and other payment methods as displayed on the checkout page. Payment processing is handled by third-party payment processors.
Taxes: Prices do not include applicable sales tax, VAT, or other taxes. You are responsible for paying all applicable taxes associated with your purchase.
4. DELIVERY
License keys are delivered electronically to the email address provided during purchase. Delivery typically occurs within 48 hours of payment confirmation. It is your responsibility to:
- Provide a valid, current email address
- Check spam/junk folders for license key emails
- Maintain secure storage of your license key
If you do not receive your license key within 48 hours, contact support with your purchase confirmation.
5. REFUND POLICY
Trial Period: The Software includes a trial period that allows you to evaluate functionality before purchase. We strongly encourage you to fully test the Software during the trial period.
No Refunds: Due to the nature of software license sales and the availability of a trial period, all sales are final. Refunds are not provided except as required by law or at Seller's sole discretion in cases of:
- Duplicate purchases made in error
- Technical issues that prevent license activation and cannot be resolved by support
- Demonstrable software defects that render the Software unusable
Refund requests must be submitted within 14 days of purchase with detailed explanation and supporting documentation.
6. LICENSE ACTIVATION AND DEACTIVATION
Activation: License keys must be activated on your computer system through the Software. Activation does not require internet connection validation.
Machine ID: Each license is tied to a unique machine identifier. However rare, hardware changes may require license reactivation.
Additional Keys: You may request additional keys for use on multiple PCs for a single amateur station/callsign. If you change callsigns, please contact us, and we can send you a new key. For additional stations under a different callsign (such as a club station apart from a trustee's personal station) require their own key purchase.
7. SUPPORT SERVICES
Licensed users receive one (1) year of technical support from the date of initial purchase. Support includes:
- Email support for installation and activation issues
- Bug fixes and patches for the current major version
- Access to software updates and improvements
Support does not include custom development, training, or support for third-party hardware/software. Support renewal after the initial year is available for an additional fee.
8. SOFTWARE UPDATES
Your license includes access to software updates and bug fixes for the current major version. Major version upgrades (e.g., 1.x to 2.x) may require an additional purchase at Seller's discretion. Updates are provided "as available" with no guarantee of specific features or timelines.
9. PROHIBITED USES
License keys are for your personal amateur radio use only. You may NOT:
- Share, publish, or distribute your license key to others
- Use a single license on multiple computer systems simultaneously, additonal keys are available on request.
- Sell, transfer, or sublicense your license to another party
- Use the Software for commercial purposes without explicit written permission
- Attempt to circumvent license activation or validation mechanisms
Violation of these terms will result in immediate license termination without refund.
10. INTELLECTUAL PROPERTY
Purchase of a license does not grant you any ownership rights to the Software. All intellectual property rights remain with the Seller. The Software is protected by copyright laws and international treaty provisions.
11. WARRANTY DISCLAIMER
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. SELLER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.
Seller does not warrant that:
- The Software will meet your specific requirements
- The Software will operate uninterrupted or error-free
- The Software will be compatible with all hardware configurations
- All defects will be corrected
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Software
- Any unauthorized access to or use of your license key
- Any interruption or cessation of transmission to or from the Software
- Any bugs, viruses, or other harmful code that may be transmitted through the Software
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content
IN NO EVENT SHALL SELLER'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE LICENSE.
13. PRIVACY AND DATA COLLECTION
License activation collects minimal information necessary for validation:
- Machine identification hash (non-reversible)
- Callsign provided during activation
- License key and activation date
This information is used solely for license management and is not shared with third parties. No personally identifiable information beyond your callsign and email and information required for the payment processor is collected.
14. TERMINATION
Seller reserves the right to terminate your license for:
- Violation of these Terms or the EULA
- Fraudulent or illegal use of the Software
- Chargebacks or payment disputes determined to be without merit
Upon termination, you must cease all use of the Software and destroy all copies in your possession.
15. MODIFICATIONS TO TERMS
Seller reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Seller's website. Your continued use of the Software after changes are posted constitutes acceptance of the modified Terms. Material changes affecting existing license holders will be communicated via email.
16. DISPUTE RESOLUTION
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.
Jurisdiction: Any disputes arising from these Terms or your purchase shall be resolved exclusively in the courts of Oklahoma.
Informal Resolution: Before filing any formal dispute, you agree to contact Seller to attempt to resolve the issue informally.
17. ENTIRE AGREEMENT
These Terms, together with the End User License Agreement (EULA), constitute the entire agreement between you and Seller concerning the purchase and use of the Software and supersede all prior agreements and understandings.
18. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

20. ACKNOWLEDGMENT
BY COMPLETING YOUR PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT YOU HAVE HAD THE OPPORTUNITY TO EVALUATE THE SOFTWARE DURING THE TRIAL PERIOD BEFORE PURCHASE.
